How to prevent reset after minimizing and maximizing?

One of my apps was rejected with the following comments:

 

If the user selects the touch menu back button to minimize the application,
then the user will notice the application reset up maximizing. 

 

Steps to reproduce: 

 

1. Launch the application.

2. Press the screen to continue.  [screen = splash screen]

3. Select the purple face.  [purple face icon starts a new game]

4. Use the touch menu back button to minimize the application.

5. Maximize the application and notice that the game resets

 

The app does the right thing on Android with regard to the back and home keys what else do I need to do to make it bb10 compatible?

Reviewers sound wrong to me. Back button from menu bar will cause currently displayed Activities onDestroy method to get called. So makes sense to "reset". Why does BB10 call onDestroy if they don't want the Activity destroyed?

 

If user swipes up from  bottom of the screen though (which is the correct way to minimize), onDestroy is not called, but onStop will be called.
