Have you tried performing a battery pull on your BlackBerry® smartphone to see if you have the same behavior on boot up? If so, I would suggest performing a backup of your BlackBerry® smartphone then reloading the software as shown in the article below:

Yes, I pulled the battery and SIM. Also did the latest update. Before the update it was randomly shutting off, the Update fixed that but now the menu button doesnt work within Emails and SMS but works every where else.
