Well I been on blackberry's website as of late looking around and I saw tonight where the 8330 is compatable for OS 5.0, I am currently on 4.5 and it sucksssss really bad. WOuld my carrier be at fault for it not updating? I used the Desktop software and it only shows my current version and two previous ones.
Thanks.

The OS version provided is designated by your provider and its up to them to provide it.. if if your phone is compatable.

You can download OS 5.0.0.438 from here. After it's downloaded, you need to install it onto your computer before you can install it onto the Berry (confusing, I know). After OS 5.0.0.438 is installed on your computer, you need to go into its folders and delete all instances of the VENDOR.XML file.
After this you go offline (to prevent DTM for checking online for updates), plug in your BlackBerry, fire up DTM and it should be able to detect the installed OS 5.0.0.438 on your computer. It should then allow you to install it.
Of course, be certain to make a backup of your current installation, lest anything go awry.

DTM = Desktop Manager.
