the first problem is that the menus are not all there.
instead of the torch symbol (dots) referenced in the online help pages, i have a little house. which takes me to one page of icons, which don't have all the options.
the function for finding my pin doesn't work as i don't get the "options" option on every screen!
is this even really a blackberry?
everything seems legit, except the software / setup.
help???

You have a little house symbol where, on one of the lower four buttons?
On the 9800 Torch , it would look like this, does yours?

yeah, so it's either reconditioned or fake.
No, it is either a BlackBerry or it is not.
Look at the picture above, I ask does your device look like this or not?
Does the bottom row of buttons match this picture?
Does your device say "BlackBerry" anywhere on it?
Under the battery on the white sticker, what does it say?

1) Look at the picture above, I ask does your device look like this or not? yes except for...
2) Does the bottom row of buttons match this picture? i have a house instead of the dots logo.
3) Does your device say "BlackBerry" anywhere on it? yes, just exactly as in the picture above. all other markings on the outside of the phone also match the official photos, the IMEI number is unique, etc.
4) Under the battery on the white sticker, what does it say? IMEI number, all other markings correct but no PIN.
until i was having problems loading new apps to my phone i didn't realize it, but after some searching, i've learned what's missing/different and think it's a fake.
ridiculous.
sorry mr. electronics store owner, but you're getting reported...

Good luck.

yes, well, thanks to you and the many people online who are reporting this kind of thing, i figured it out before i wiped the software on it... at least it works as a phone and i can buy a new (and REAL) one before i confront the store owner for a return on my money (and then report him to the NYC bureau of consumer affairs, which loves counterfeit goods cases these days!)
thanks again for the good community here and quick response.
all the best.
