When you received your BlackBerry® Torch™ 9800 smartphone had a security wipe been done on it to remove the previous owner's information and BlackBerry® ID? If not, you will need to backup your data and perform one and then setup the BlackBerry® Torch™ 9800 smartphone with your own BlackBerry® ID. This KB article should help.
