i upgraded but all it says is setting up bbm/temporary server error, yes my wifi works and yes i rebooted

BBM requires an active data plan from your mobile network provider. I suggest verifying with them that you have the correct data services enabled.

let me get this straight, there has to be a data plan in place to use bbm with wifi? i dont see how that makes sense

That's right. A supported data plan from your wireless service provider is required to use BBM. You can check out the system requirements right here in the release notes. http://bbry.lv/Z738ZK

The Wi-Fi connection would be to keep BBM usage from adding to your data usage.
