There are no "rules" to the boundaries of the icons. Mine are free standing icons with transparent backgrounds. I've seen some that are just a box. Others have tried to overly their icon on the "translucent cube" that is seen for some apps.
I personally dont know if the free style of icons are good for the device in general. I personally like how Apple icons have a basic consistent look to them. But without some form of template from BB, other than size, you are free to do what you like.

I think everyone should just stick with the latest official recommendations, which clearly say the size should be 86x86, with the main content in a 77x77 area within that. Other suggestions are on that same page.

By the way, in this post I supplied icon template files based on the recommendations. The key one is an SVG source file created in Inkscape. Using it you can (with a basic knowledge of Inkscape) import any bitmap and have it exported as a correctly sized (86x86) PNG that has the translucent box overlaid. I'll update that when and if the recommendations change. There's an EPS file export based on that, but I have no way to test how well that one works in, say, Illustrator, and haven't heard from anyone else whether it's useful.
