Scary stuff. When the government gets involved in an investigation, all logic goes out the door. I feel bad for that independent developer. His reputation could be trashed by this and hopefully he has the liability protection of an LLC.

That's quite interesting, assuming it's really what the complaint is about. Even RIM's Advertising Service docs, for example, encourage you to do the same thing. (They mention age rather than birth date, but I think that's just in the "default" support, and devs could include more.)
Definitely an issue to follow closely for anyone thinking of using this feature.

Several months ago, wsj.com had a series of stories on online privacy, exposing what was apparently not-well-known detail on how much information is being tracked without your informed consent. Browser makers are now supposedly coming out with opt-out (or are they opt-in, I don't recall) features for this kind of stuff. Legal and regulatory developments in this area definitely bear monitoring. We do have a government in place in the USA that is more activist than the prior administration.
