I just got a Blackberry Curve 8330 and so far, every night it attempts to voice dial in the middle of the night. When I wake up & look at my phone it is on the "attempting to voice dial" screen that I have to exit out of. If it's not plugged in, it drains the battery quite a bit as well. Any suggestions?

Hi and welcome!
Do you leave Bluetooth connected or disabled?

Do you use a wall charger or USB to charge?
Also if you have one of your convenience keys set to Voice dialing try turning it off for a night.

I use a wall charger.
One convenience key is set to Keyguard & the other is set to Phone Book.
I tried setting the key guard last night as well but it was doing the same thing this morning when I woke up. It never does it during the day though. Weird.

Yea, Exorcist might be a good call.....I didn't set any auto reboots or non-default clock functions. I've only had the phone since Saturday so haven't really had time to set too many custom settings. I'm not sure what time it happens at night, I just know that when I wake up it is always searching the address book for voice dial.
I went to the voice dial icon & made sure it was disabled & also removed (hide) it from the application/menu screen. We'll see how that works.

During the day can you lay it on the desk and see what happens?
I mean bring the charger and leave it where you can see it.
Let's not avoid the problem let's fix it, or retrun the phone while under warranty.
