I have had the #9790 for about a month and the touchscreen is no longer functioning properly. This is not from any physical damage. I have done a battery pull and a full reload of the software with no improvement. Help!

Yes its possible. you've looked at all software options. All that is left is the hardware now.

6 weeks! wow, will they provide you a loaner phone? Also its OK for the device to get warm when using an app.
its using the celluar radio for GPS and that taxes the battery somewhat.

One more quick question as waiting 6 weeks with a sub par loaner phone and possible glitches to my business dont get me too excited. Is the non replacement of a phone after 30 days, actually a Blackberry Policy or would it be a carrier policy?

That sounds like a carrier policy to me. Each carrier is different with their exchange programs.
