Data roaming with Data roaming turned off

I have a factory unlocked 9300 currently on fido network in Canada  (  Won in a contest from rim ) I was billed for 5kb data while roaming in US  data roaming is turned off (was never on ) how is this possible ?

I work for my carrier and they say it is a bb issue

Well, if you work for your carrier, then you already should understand everything that I linked for you above (e.g., that this site is not a channel to ask BB for anything). You have your own channels to ask questions of BB, channels to which the general public does not have access.
