Let's do a battery pull to see if it's related to a software issue or not. Remove your battery while your phone is powered on then replace it.
If that corrects the issue, it was software-related. If it does not, chances are it's a hardware issue and you should see your carrier about it.

It IS a problem because the user should be able to use the phone in the opened or closed position.

Thanks for your comments, several times before I took the battery out while the device is on and replace and it doesn't fix the problem, also I deleted all photos, music and video to check if this could be affecting the device. I think I will start uninstalling applications and see if any could be generating the issue because I need this phone operating at 24*7 and sending the phone for repair is not an option
