I don't think you need a permission - but there is the access_wifi_public permssion added in 10.2...
However - the documentation lists lots of reasons why you could get back a busy error. (Are you getting a busy error?)
* Wifi is the default route for one of the permieters
* Some other app is bound to WiFi connectivity...

I dont know how it is, but it is possible some way as SayIt was just updated with features that turn wifi & bluetooth on & off... I thought of you when I read the post last night
